Terms of Use

Effective October 31, 2026

These Terms are an agreement between you and Big Blue Sky Labs, LLC, an Arizona limited liability company ("we," "us"), for My Travel Challenge at app.mytravelchallenge.com, mytravelchallenge.com and our future mobile apps (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

1. Eligibility and your account

• You must be at least 13 years old. If you are under 18, a parent or guardian must agree to these Terms for you.
• Give us accurate information and keep your sign-in secure. You're responsible for what happens under your account.
• One person per account. Don't create accounts to collect extra rewards or AI searches.
• Tell us right away at hello@mytravelchallenge.com if you think someone else is using your account.

2. Your content

You own what you add: places, trips, ratings, notes, messages, photos and challenges ("Your Content"). You give us a worldwide, non-exclusive, royalty-free license to host, store, display and process Your Content only to run, improve and promote the Service, including showing it to the people you share it with. The license ends when you delete the content or your account, except for content others still rely on in a shared challenge, which we may keep without your name.

Templates. If you publish a challenge as a ready-made list, other users may copy it and use it in their own challenges.

Your responsibility. You confirm you have the right to post Your Content and that it doesn't break the law or anyone's rights.

3. Invitations

When you invite someone, we send an email on your behalf with your name and any note you add. Invite only people you know who would welcome it. Don't use invitations, referrals or rewards to send spam, and don't create fake accounts to earn stamps or extra searches. We may limit or remove rewards gained this way.

4. Acceptable use

Don't:

• harass, threaten or impersonate anyone, or post hateful, sexual, violent or illegal content;
• post anyone else's private information without their permission;
• try to break into, overload, scrape or reverse-engineer the Service, or get around usage limits;
• use the Service to send spam or for commercial promotion without our permission;
• use the AI features to produce harmful or misleading content.

We may filter, hide or remove content that breaks these rules, including profanity and inappropriate images, and suspend accounts that break them. You can report content or a person to us at hello@mytravelchallenge.com, and with in-app report and block tools as they become available.

5. AI suggestions, places and events

• AI suggestions come from a third-party AI model and public web pages. They can be wrong or out of date: a restaurant may have closed, a special may have ended, or a show's dates or prices may have changed. Each suggestion is labeled "check before you go" for this reason.
• Always confirm hours, dates, tickets, prices, safety and accessibility directly with the venue before you go.
• We don't own, run or endorse the restaurants, venues, events or other places shown in the Service, and we aren't responsible for them. Links to other websites are provided for convenience.
• Travel involves risk. You're responsible for your own plans, safety, travel documents and decisions.

6. Plans, limits and payments

• The Service is free to start. Free accounts include a limited number of AI "smart searches"; the current allowance is shown in the app and may change.
• We may set or change usage limits to keep the Service running fairly. Rewards such as stamps and bonus searches have no cash value and can't be transferred or sold.
• If we offer paid plans, we will show the price, billing period, renewal terms and how to cancel before you buy. Purchases made in the iPhone or Android app are billed by Apple or Google, and refunds follow their policies.

7. Our Service and our rights

The Service, its design, name, logo, stamps and software belong to us and our licensors. You may use the Service only as these Terms allow. We may change, add or remove features. If you send us ideas or feedback, we may use them without paying you.

8. Ending your account

You can delete your account at any time. We may suspend or close an account that breaks these Terms, puts others at risk, or could expose us to legal liability. Where reasonable, we will tell you first. Sections 2 (license for shared content), 5, 9, 10, 11 and 12 survive.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DON'T PROMISE THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT AI SUGGESTIONS OR PLACE AND EVENT INFORMATION ARE ACCURATE.

10. Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE SERVICE IS LIMITED TO THE GREATER OF $10 OR WHAT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. SOME PLACES DON'T ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU. NOTHING IN THESE TERMS LIMITS LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, FRAUD, OR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, WHERE THE LAW DOES NOT ALLOW IT.

11. Indemnity

You agree to defend and hold us harmless from claims arising from Your Content, your use of the Service, or your breach of these Terms, to the extent the law allows.

12. Disputes and governing law

Arizona law governs these Terms, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at hello@mytravelchallenge.com and try to resolve it informally for 30 days. If we can't resolve it, any dispute will be decided by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in Maricopa County, Arizona or by video. Either of us may instead bring an individual claim in small claims court. You and we each give up the right to a jury trial and to bring or join a class or representative action. You may opt out of arbitration by emailing hello@mytravelchallenge.com within 30 days of first accepting these Terms. If this arbitration clause is found unenforceable, disputes go to the state or federal courts in Maricopa County, Arizona.

13. Changes to these Terms

We may update these Terms. We will post the new version here with a new effective date and, for significant changes, tell you in the app or by email before they take effect. Using the Service after that means you accept the changes.

14. General

These Terms and the Privacy Policy are the whole agreement between us about the Service. If a part can't be enforced, the rest still applies. Not enforcing a term isn't a waiver. You may not transfer these Terms; we may transfer them with the Service. If you use our iPhone app: these Terms are between you and us, not Apple. Apple is not responsible for the app, its content, maintenance, support, or any claims about it, and has no warranty obligation beyond refunding the purchase price, if any. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
